I think the problem with SN was that it was one of the proprietary custom systems Andy mentioned, that were never supposed to be distributed.
Like Talli said, there's no problem keeping your OpenACS-based code closed source as long as you're keeping it to yourself. AFAIK there was some misconception which led to the ******** source being published in the first place.
